Cerebral palsy is a group of disorders that affects the brain and motor skills. Although genetic defects, premature birth, and other unavoidable factors can lead to cerebral palsy, many children develop cerebral palsy as a result of medical negligence during pregnancy, labor and delivery, or in the child's first year of life, such as:

  • Labor and delivery complications: According to the National Institute of Neurological Disorders and Stroke (NINDS), birth complications, such as asphyxia (lack of oxygen to the brain), account for approximately five to ten percent of cases of cerebral palsy. A doctor's failure to monitor for signs of fetal distress and failure to perform a timely cesarean section (C-section) can prolong the oxygen deprivation — causing the baby to develop cerebral palsy.
  • Infections: Failure to treat certain infections in the mother during pregnancy or in the infant can cause brain damage to the fetus or infant. For example, a doctor's failure to promptly treat severe jaundice or meningitis can cause the baby to suffer brain damage that ultimately results in cerebral palsy.
